A seven-man panel of the Supreme Court has on Friday declared President Muhammadu Buhari financial stance on the E010 as unlawful and unconstitutional.
Why it matters?
The E010 is an executive order for the judiciary and legislative arms of the government finances to be autonomous. This executive order would see the funding of state courts not lie within the jurisdiction of the state government.
In the judgment delivered by the Supreme Court panel, the members disagreed on such autonomy with President Buhari. Justice Musa Datijo Muhammad prepared the panel’s decision, while Justice Centus Nweze explained that the state government should solely dictate the funding available to state courts.
State governors in May 2020 had filed that the state government should fund the state courts bill while the Federal Government catered for capital projects of high courts.
